Please read these Terms of Service (“Terms”) carefully before using the MyNextOffer platform (the “Service”) operated by MyNextOffer, LLC (“MyNextOffer,” “we,” “us,” or “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
By creating an account or using the Service in any manner you confirm that you are at least 13 years of age and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated by reference. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf. These Terms constitute a legally binding agreement between you and MyNextOffer, LLC. We reserve the right to update these Terms at any time. Continued use after modifications constitutes acceptance.
MyNextOffer is a software-as-a-service (SaaS) platform designed to help high school student athletes and their families navigate the college athletic recruiting process. The Service includes:
MyNextOffer is a technology platform, not a recruiting agency, sports agent, or consulting service. We do not represent athletes, negotiate on their behalf, or contact coaches on their behalf.
To access most features you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Notify us immediately at legal@mynextoffer.io of any unauthorized use of your account. MyNextOffer will not be liable for any loss or damage arising from your failure to maintain account security.
You may close your account at any time by contacting support. Upon termination your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes in accordance with our Privacy Policy.
MyNextOffer offers free and paid subscription tiers. Paid plans are billed on a monthly or annual basis as selected at checkout. Features and pricing are described on our pricing page and are subject to change with notice.
All payments are processed by Stripe, Inc. By providing payment information you authorize MyNextOffer and Stripe to charge your payment method for applicable fees. MyNextOffer does not store full credit card numbers.
Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting support.
All subscription fees are non-refundable except where required by applicable law. If you cancel, you retain access to paid features until the end of your current billing period. Prorated refunds for partial months are not provided.
Free trial periods may be offered for paid plans. At the end of the trial your account will automatically convert to the selected paid plan unless cancelled before the trial ends.
MyNextOffer reserves the right to change subscription pricing at any time. Existing subscribers will receive at least 30 days’ advance notice via email.
MyNextOffer does not guarantee that using AI-generated content will result in any coach response, athletic scholarship offer, college admission, or any other recruiting outcome. Recruiting decisions are made solely by colleges and their coaching staffs, over whom MyNextOffer has no influence or control.
MyNextOffer explicitly does not guarantee, promise, imply, or represent that use of the Service will result in any athletic scholarship offer of any kind, at any division level, from any institution. Any AI-generated content referencing scholarships is informational only.
All AI-generated strategy, school recommendations, division fit assessments, and recruiting timelines are advisory in nature only. They are based on general patterns and the information you provide and do not constitute professional recruiting consulting advice. Exercise your own judgment and consult qualified advisors as appropriate.
AI-generated content may contain inaccuracies, errors, or outdated information. You are solely responsible for reviewing, verifying, and editing all AI-generated content before using it to contact coaches, schools, or any other parties. MyNextOffer is not liable for consequences arising from unreviewed or unedited use of AI-generated content.
Coach contact information and school data are provided for informational purposes and may not be current or accurate. You are responsible for verifying contact information before use. MyNextOffer is not responsible for misdirected communications.
Recruiting activities are governed by rules established by organizations including the NCAA, NAIA, and NJCAA. You are solely responsible for ensuring your recruiting activities comply with all applicable rules and regulations. MyNextOffer is not affiliated with, endorsed by, or responsible for the rules of any athletic governing body. Nothing in the Service constitutes legal advice regarding recruiting eligibility or compliance.
You are solely responsible for the accuracy of the athlete information you submit. Do not exaggerate or misrepresent stats, GPA, test scores, or any other information. Misrepresentation to college coaches may have serious consequences for your eligibility and reputation.
You agree not to use the Service to:
MyNextOffer reserves the right to suspend or terminate accounts that violate these prohibitions at our sole discretion, without notice or refund.
The Service, including its design, software, content, trademarks, logos, and all intellectual property therein, is owned by or licensed to MyNextOffer, LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our express written consent.
You retain ownership of the athlete profile information, statistics, and other content you submit (“User Content”). By submitting User Content you grant MyNextOffer a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.
AI-generated content produced using your inputs is provided to you for personal use in connection with your recruiting activities. You may not resell, license, or commercially distribute AI-generated output from the Service.
Any feedback, suggestions, or ideas you provide about the Service may be used by MyNextOffer without obligation or compensation to you.
The Service may contain links to or integrate with third-party websites and services (such as Hudl, YouTube, Stripe, and Anthropic). MyNextOffer does not control and is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is subject to their respective terms and policies.
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service you consent to the data practices described in our Privacy Policy.
The service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. MyNextOffer does not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. No advice or information obtained from MyNextOffer or through the service will create any warranty not expressly stated in these terms.
To the maximum extent permitted by applicable law, in no event shall MyNextOffer, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, scholarship opportunities, or other intangible losses, arising out of or in connection with your use of or inability to use the service, even if MyNextOffer has been advised of the possibility of such damages.
In no event shall MyNextOffer’s total cumulative liability to you for all claims exceed the greater of (a) the total amount paid by you to MyNextOffer in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
You agree to indemnify, defend, and hold harmless MyNextOffer, LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your User Content; (d) your violation of any third-party right; or (e) your violation of any applicable law or regulation.
MyNextOffer reserves the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination all licenses granted herein terminate immediately. Sections 5, 7, 10, 11, 12, 14, and 15 shall survive termination of these Terms.
Before initiating any formal proceeding, you agree to contact us at legal@mynextoffer.io and attempt to resolve the dispute informally for at least 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if eligible.
You and MyNextOffer each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in North Carolina.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyNextOffer regarding the Service and supersede all prior agreements.
If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
Failure to enforce any right or provision will not be deemed a waiver of such right or provision.
You may not assign these Terms without our prior written consent. MyNextOffer may assign these Terms without restriction.
